House to Consider Bill Mandating Radios in New Manufactured Houses

11/30. The House is scheduled to consider HR 320 [LOC | WW], the "CJ's Home Protection Act of 2009", on Wednesday, December 2, or Thursday, December 3, 2009. See, Rep. Hoyer's schedule for the week of November 30.

This bill, if enacted, would amend 42 U.S.C. § 5403 to provide that "each manufactured home delivered for sale shall be supplied with a weather radio inside the manufactured home that ... is capable of broadcasting emergency information relating to local weather conditions ..."

This requirement would only apply to a new "Federal manufactured home". 42 U.S.C. § 5402 provides that this is "a structure, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width or forty body feet or more in length, or, when erected on site, is three hundred twenty or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling ..."

House to Consider SEC Subpoena Bill

11/30. The House is scheduled to consider HR 2873 [LOC | WW], the "Enhanced S.E.C. Enforcement Authority Act", on Wednesday, December 2, or Thursday, December 3, 2009. See, Rep. Hoyer's schedule for the week of November 30.

This bill, if enacted, would override parts of Rule 45, Federal Rules of Civil Procedure (FRCP), in actions brought under federal securities statutes, by providing that subpoenas issued by one U.S. District Court may be served and enforced anywhere.

It would enhance the ability of the SEC to engage in forum shopping.

It would also decrease the ability of subpoena recipients, including investigative reporters, to challenge improper or burdensome subpoenas. It would enable the SEC to obtain a subpoena for a reporter's notes from a government friendly judge in a distant district where the reporter is not represented by legal counsel.

The SEC has a history of abusive issuance of subpoenas to journalists. There is also pending legislation titled the "Free Flow of Information Act of 2009". HR 985 [LOC | WW] is the House version of the bill. S 448 [LOC | WW] is the Senate version. The House passed HR 985 on March 31, 2009. The Senate Judiciary Committee (SJC) is scheduled, again, to consider S 448 on December 3, 2009.

These are broad bills, also referred to as "media shield", that would limit the ability of federal entities to compel journalists to provide testimony or documents, or disclose sources, related to their work. These bills would also limit government access to records of carriers, ISPs and other service providers.

None of these media shield bills have yet been enacted into law, in part, because of the opposition of the Obama and Bush administrations. See for example, story titled "Bush Administration Opposes Pence/Boucher Free Flow of Information Act" in TLJ Daily E-Mail Alert No. 1,757, April 30, 2008.

FCC Requests Proposals to Be Designated White Spaces Database Administrator

11/25. The Federal Communications Commission (FCC) released a Public Notice (PN) in its white spaces proceeding requesting proposals to be designated database administrator.

The FCC adopted its white space order on November 4, 2008, and released the text [130 pages in PDF] on November 14, 2008. It is FCC 08-260 in ET Docket No. 04-186. This PN explains that "To prevent interference to authorized users of the TV bands, TV band devices must include a geo-location capability and the capability to access a database that identifies incumbent users entitled to interference protection, including, for example, full power and low power TV stations, broadcast auxiliary point-to-point facilities, PLMRS/CMRS operations on channels 14-20, and the Offshore Radiotelephone Service. The database will tell a TV band device which TV channels are vacant and can be used at its location." (Footnotes omitted.)

This PN requests written proposals to be designated as TV band database managers. This PN also specifies the topics to be covered in these proposals.

The deadline to submit proposals is January 4, 2010. The deadline to submit initial comments on those proposals is February 3, 2010. The deadline to submit reply comments is February 18, 2010. This item is DA 09-2479 in ET Docket No. 04-186.

Harold Feld of the Public Knowledge stated in a release on November 25, 2009, that "We are very pleased that the FCC has moved ahead to implement its order from last year allowing broadband service to be offered in the so-called 'white spaces' between digital TV channels." He added that "Selecting an administrator for the white spaces database is a crucial step toward bringing consumers another choice in a restrictive broadband marketplace. We expect that use of the white spaces spectrum will foster innovation and create jobs as new devices and services become available."

White space is a term used by the FCC and others to describe broadcast television spectrum where the spectrum is not in use by broadcasters.

Tom Hazlett, a professor of law and economics at George Mason University, participated in a panel discussion hosted by the Progress & Freedom Foundation (PFF) on wireless issues on October 19, 2009. He stated then that "294 megahertz are white space". (The FCC long ago allocated a total of 294 megahertz for television.)

That is, Hazlett argued that the entirety of over the air television broadcasting is a waste of valuable spectrum that could be put to better use. He added that "if we sprinkle in fragmented non-exclusive rights all around the TV stations, that will simply freeze the 1952 TV allocation in for another generation of waste and spectrum mismanagement".

The PFF will host a panel discussion on December 1, 2009, at 9:00 AM titled "Let's Make a Deal: Broadcasters, Mobile Broadband, and a Market in Spectrum". See, notice.
