FTC to Seek to Compel Disclosures
by Patent Assertions Entities |
9/26. The Federal Trade Commission (FTC)
released a
notice [17 pages in PDF], to be published in the Federal Register (FR), that
announces that it seeks information on patent assertion entities (PAEs) and "other
entities asserting patents in the wireless communications sector, including
manufacturers and other non-practicing entities and organizations engaged in
licensing".
This notice states that the FTC plans to issue
compulsory process orders to PAEs and other entities. These orders, which are in
the nature of subpoenas, will seek information regarding patent acquisition,
litigation, and licensing practices. The FTC will seek written responses, and
production of documents.
Before issuing such orders, the FTC will submit
a request for review by the Executive Office of the President's (EOP)
Office of
Management and Budget (OMB), as required by the Paperwork Reduction Act (PRA),
44 U.S.C. §§ 3501-3521.
This notice recites the questions to be asked of
PAEs. It is eleven pages in single spacing. This notice underestimates the costs of
compliance to the entities that will be required to respond.
Ed Black, head of the Computer and
Communications Industry Association (CCIA), stated in a release that "This
vote by the FTC is an encouraging sign that the Administration is committed to
investigating the practices of patent trolls, and we commend them on this step.
While previous studies have estimated that PAEs cost the economy $29 billion,
the ability to dig deeper into the numbers will be useful."
GAO Report. The Congress's Government
Accountability Office (GAO) recently completed a related
report [61 pages in PDF], as
required by the patent reform act enacted in 2011.
Section 34 of the "Leahy-Smith America Invents Act", or AIA, mandated
this report. The AIA act was HR 1249

the 112th Congress. The GAO released its report on August 22, 2013.

That GAO report relied upon entities voluntarily providing information, and hence,
the GAO was hampered by lack of information on many key issues.
The FTC's study will be more focused (to just the wireless communications sector),
and more thorough and systematic. However, the critical difference is that it will be
based upon compulsory process.

and the Federal Trade Commission (FTC) held a day long
workshop on December 10, 2012, titled "Patent Assertion Entity Activities". See,

notice in the FR. As of the October 2 issue of the FR, such notice had not yet been
published.

Supreme Court Grants
Cert in Case Involving Laches As Defense to Copyright Infringement |
10/1. The Supreme Court granted
certiorari in Petrella v. MGM, a copyright case in which the issue before the
Supreme Court is whether the defense of laches is available without restriction to
bar all remedies for civil copyright claims filed within the three year statute of
limitations prescribed by 17
U.S.C. § 507(b). See, October 1, 2013

The Supreme Court stated in its
document titled
"Question Presented" that "The Copyright Act expressly prescribes a
three-year statute of limitations for civil copyright claims. 17 U.S.C. § 507(b). The
three-year period accrues separately for each act of infringement, even if it is
one of a continuing series of acts of infringement."
It added that "The federal courts of appeals have divided 3-2-1
over whether the nonstatutory defense of laches can bar a civil copyright suit
brought within the express three-year statute of limitations. Three circuits
forbid any application of laches or restrict the remedies to which it can apply.
Two other circuits strongly disfavor laches and restrict it to exceptional
circumstances. The Ninth Circuit not only does not restrict laches or the
remedies to which it can apply, but has also adopted a presumption in favor of
applying laches to continuing copyright infringements."
Section 507(b) of the statute provides, in full, that "No civil
action shall be maintained under the provisions of this title unless it is
commenced within three years after the claim accrued."
Laches is an affirmative defense, arising in equity, that bars a
claim based upon unreasonable delay.
Paula Petrella is the daughter of Frank Petrella, who collaborated Jake LaMotta
to produce a book, a screenplay in 1963, and a second screenplay in 1973, about
the retired boxer. The elder Petrella registered copyrights in these works. MGM
made a movie in 1980, titled "Raging Bull", based on these works.
In 1976 the elder Petrella and LaMotta assigned certain rights to Chartoff-Winkler
Productions, Inc., which latter assigned rights to United Artists, a subsidiary of MGM.
Frank Petrella died, leaving his daughter Paula Petrella as heir.
She learned of the Supreme Court's 1990 opinion in Stewart v. Abend,
495 U.S. 207, in 1990. That case pertains to successors' renewal rights when the
original author dies before a renewal period begins. She hired an attorney.
However, she first asserted rights in the 1963 screenplay in 1998. She filed a
complaint in the U.S. District Court (CDCal) against various MGM companies and
others, alleging that the movie is an infringing derivative work. However, she
did not file until 2009.
The District Court held that Petrella's copyright infringement claim is barred by
the doctrine of laches. She appealed.
The U.S. Court of Appeals (9thCir)
issued its
opinion, which is also reported at 695 F.3d 946, on August 29, 2012. It
affirmed the judgment of the District Court.
It wrote that the three elements of the doctrine of laches are that "the
plaintiff delayed in initiating the lawsuit", that "the delay was
unreasonable", and that "the delay resulted in prejudice".
The Court of Appeals, like the District Court, found that the plaintiff delayed
a total of 19 years, that was unreasonable, and it resulted in prejudice to the movie
company defendants.
This case is Petrella v. MGM, Supreme Court of the U.S., Sup. Ct. No.
12-1315, on petition for writ of certiorari to the U.S. Court of Appeals for the
9th Circuit, App. Ct. Nos. 10-55834 and 10-55853. The Court of Appeals heard
appeals from the U.S. District Court for the Central District of California,
D.C. No. 2:09-cv-00072-GW-MAN.
Judge Raymond Fisher wrote the opinion of the Court of Appeals,
in which Judge Jack Zouhary (USDC/NDOhio, sitting by designation) joined. Judge
William Fletcher wrote a concurring opinion.
Petrella is represented before the Supreme Court by Stephanos Bibas of the
University of Pennsylvania Law School Supreme Court Clinic. MGM is represented by
Mark Perry of the Washington DC office of the law firm of Gibson Dunn & Crutcher.

Supreme Court to Examine Award of Attorney

10/1. The Supreme Court granted certiorari
in Octane Fitness v. ICON Health & Fitness, Sup. Ct. No. 12-1184, a patent
infringement case in which the sole issue before the Supreme Court is the award of

The question
presented is "Does the Federal Circuit's promulgation of a rigid and
exclusive two-part test for determining whether a case is ``exceptional´´ under
35 U.S.C. § 285 improperly appropriate a district court's discretionary
authority to award attorney fees to prevailing accused infringers in
contravention of statutory intent and this Court's precedent, thereby raising
the standard for accused infringers (but not patentees) to recoup fees and
encouraging patent plaintiffs to bring spurious patent cases to cause
competitive harm or coerce unwarranted settlements from defendants?".

35 U.S.C. § 285
provides in full that "The court in exceptional cases may award reasonable
attorney fees to the prevailing party."
The U.S. Court of Appeals (FedCir)
devoted few words to this issue. It wrote in its October 24, 2012
opinion that "Octane relies on ICON's allegedly unreasonable claim
construction positions, its privilege assertions over its pre-suit
investigation, and emails allegedly supporting bad faith litigation in an effort
to "go after" Octane. In addition, Octane seeks to lower the standard for
exceptionality to "objectively unreasonable" to rebalance what it alleges as the
power of large companies over smaller companies in patent infringement
litigation. However, we have reviewed the record and conclude that the court did
not err in denying Octane's motion to find the case exceptional. We have no
reason to revisit the settled standard for exceptionality."
When and why to award costs and attorneys fees in patent litigation is also
at the center current debates in the Congress regarding reforming patent
procedure to reduce meritless claims asserted by non-practicing entities, patent
assertion entities, and/or patent trolls.

National Telecommunications and Information Administration (NTIA) published

meeting on October 30, 2013 to discuss its

Policy Task Force's (IPTF)

evaluates the extent to which major federal agencies have
implemented the requirements of Federal Information Security Management
Act of 2002 (FISMA) as amended to ensure the effectiveness of
information security controls over information resources that support federal
operations and assets. It states that while agencies made progress in FY 2012,
the GAO and inspectors general "continue to identify weaknesses in agencies'
information security programs".

the creation of two programs for temporary employment of scholars. First, it created
a Kaminstein Scholar in Residence Program for established scholars of copyright law.
Abraham Kaminstein was the Register of Copyright from 1960 through 1971.
Robert Brauneis
(George Washington University law school) was named the first Kamenstein Scholar, for
the 2013-2014 academic year. Second, the CO created a Ringer Copyright Honors Program
for recent law school graduates. Barbara Ringer was the Register of Copyright from 1973
