House Passes Commerce, Justice and Science
Appropriations Bill |
5/30. The House amended and passed HR 4660
[LOC |
WW], an
untitled bill that makes "appropriations for the Departments of Commerce
and Justice, Science, and Related Agencies for the fiscal year ending September
30, 2015". The vote on final passage was 321-87. See,
Roll Call No. 269.
This bill contains appropriations for many of the technology related
agencies. This bill does not include appropriations for the Federal
Communications Commission (FCC) or Federal Trade Commission (FTC). Their
appropriations fall within the jurisdiction of the Subcommittee on Financial
Services and General Government.
This bill contains a clause that bars any federal funds from being used to
implement the National Telecommunications and Information Administration's (NTIA)
plan to relinquish control over internet domain name system functions.
Thus, the House in two weeks has passed two huge must pass bills that contain
provisions that undo President Obama's plan, announced in March, to relinquish
NTIA control over internet domain name system functions.

The Senate Appropriations Committee's
(SAC) Subcommittee on Commerce, Justice, Science and Related Agencies met to mark up its
Commerce, Justice, Science and Related Agencies appropriations bill on June 3. The full SCC
will meet to mark up the bill on June 5.
USPTO Funding. While this bill contains an appropriation for the
U.S. Patent and Trademark
Office (USPTO), the USPTO is in reality is funded by fees collected by the USPTO.
Moreover, the Congress has a long history of diverting some of these user fees
to subsidize other government spending.
However, this bill provides that if the USPTO collects less than the appropriated
amount, the USPTO appropriation is accordingly reduced, and that if it collects more than
the designated amount, then the excess "shall remain available until expended".
Section 562 of this bill provides that "None of the funds made available by this
Act may be used to relinquish the responsibility of the National Telecommunications and
Information Administration with respect to Internet domain name system functions, including
responsibility with respect to the authoritative root zone file and the Internet Assigned
Numbers Authority functions."
NTIA Relinquishment of Internet Authority. The House previously passed
a huge bill that contains the text of the DOTCOM Act. See, stories titled "House

On May 22, the House passed HR 4435
[LOC |
WW], the
"National Defense Authorization Act for Fiscal Year 2015" on May 22, 2014, by a
vote of 325-98. See, Roll Call No.
240. The House approved an amendment offered by Rep.
John Shimkus (R-IL) by a vote of 245-177 that contains the text of HR 4342
[LOC |
WW], the DOTCOM
Act.
It requires that the Government Accountability Office
(GAO) write a report regarding a proposal that the NTIA receives "relating to the
relinquishment of the responsibility of the NTIA over Internet domain name system functions".
It further provides that until then, the NTIA "may not relinquish or agree to any
proposal relating to the relinquishment of the responsibility" of the NTIA "over
Internet domain name system functions, including responsibility with respect to the
authoritative root zone file, the Internet Assigned Numbers Authority functions, and related
root zone management functions."

Rep. Gerlach Again Introduces Startup
Innovation Credit Act |
5/21. Rep. Jim Gerlach (R-PA) and others
introduced HR 4696 [
LOC | WW], the
"Startup Innovation Credit Act of 2014", a bill to allow some start up companies
a credit against payroll taxes for certain research expenditures.
The Internal Revenue Code (IRC) has a research and development (R&D) tax credit.
(It has expired, but is likely to be extended.) It is a credit against income tax liability.
Start up companies tend not to have income tax liability, and hence, the existing credit
against income tax liability is of no use to them. This bill would enable certain startup
companies to claim a R&D tax credit against their employment taxes, instead of their
income taxes.
Section 41 of the Internal Revenue Code (IRC), which is codified at
26 U.S.C. § 41, pertains to
the "Credit for increasing research activities". This bill would add a new
subsection 41(i) regarding "Treatment of Credit to Qualified Small Businesses".
Section 3111 of the IRC, 26 U.S.C.
§ 3111, pertains to employer tax rates. This bill would add a new subsection 3111(f)
regarding "Credit for Research Expenditures of Qualified Small Businesses".
The will was referred to the House Ways and
Means Committee (HWMC). Rep. Gerlach is a member. The other original cosponsors are
Rep. Ron Kind (D-WI),
Rep. Mike Kelly (R-PA), and
Rep. Gary Peters (D-MI).
Rep. Mike Honda (D-CA), who represents a Silicon
Valley area district, joined as a cosponsor on May 23. Rep. Kind and Rep. Kelly are HWMC
members. Rep. Peters and Rep. Honda are not.

The R&D tax credit expired on December 31, 2013. The Congress has a long history of
belatedly enacting short extensions, and usually retroactive, to the credit.

Defendant Pleads Guilty in Counterfeit
Integrated Circuits Case |
6/3. Peter Picone pled guilty in U.S. District
Court (DConn) to violation of 18
U.S.C. § 2320 in connection with his having imported counterfeit integrated circuits
(ICs) from the People's Republic of China (PRC) and resold them to customers in the U.S.,
including defense contractors.
The Department of Justice (DOJ) stated in a
release that "Picone
conspired with his suppliers in China and Hong Kong to sell millions of dollars’ worth of ICs
bearing the counterfeit marks of approximately 35 major electronics manufacturers, including
Motorola, Xilinx and National Semiconductor. Picone sold counterfeit ICs to contractors
knowing that they would be supplied to the United States Navy for use in nuclear
submarines."
The DOJ added that "ICs purchased from Picone had been resurfaced to change the date
code and to affix counterfeit marks, all in order to hide their true pedigree."
Section 2320 was first enacted in 1984. However, the Congress rewrote Section 2320 in
2011, adding language regarding counterfeit military goods and services. See, Section 818

the "National Defense Authorization Act for Fiscal Year 2012", Public Law No.
112-81.
Section 818 added a prohibition of trafficking "in goods or services
knowing that such good or service is a counterfeit military good or service the
use, malfunction, or failure of which is likely to cause serious bodily injury
or death, the disclosure of classified information, impairment of combat
operations, or other significant harm to a combat operation, a member of the
Armed Forces, or to national security". It also provided for the imposition of
larger fines and longer periods of incarceration.
Section 818 is a huge section which pertains broadly to "Detection and
Avoidance of Counterfeit Electronic Parts". It also directed the Department of
Defense (DOD) to write rules "to address the detection and avoidance of
counterfeit electronic parts".
The DOD published these rules on May 6, 2014. See,

Copyright Office to Hold Roundtable on
Audits of Statements of Account and Royalty Payments |
6/3. The Copyright Office (CO) announced in a
notice in
the Federal Register (FR) that it will host a roundtable on July 9, 2014 regarding a
new procedure to allow copyright owners to audit the Statements of Account and royalty
payments that cable operators and satellite carriers deposit with the CO.
The deadline to submit requests to participate is June 26, 2014. See,
form for submitting
requests.
This event is free and open to the public. It will be held in Room LM-403 of
the Madison Building of the Library of Congress. See, FR, Vol. 79, No. 106, June

The Satellite Television Extension and Localism Act of 2010 (STELA) includes a provision
that allows copyright owners to audit certain Statements of Account. That bill was

Congress. It is Public Law No. 111-175.
On January 31, 2012, numerous copyright owners filed a
Petition for
Rulemaking, to which they attached proposed rules.
The CO has already issued and received written comments on two notice of proposed
rulemakings (NPRMs). And, late last year, the CO adopted an interim rule.
The CO issued its first NPRM in June of 2012. See,

The CO issued its second NPRM in May of 2013. See,

group of copyright owners, the National Cable & Telecommunications Association (NCTA),

The just released notice also asks numerous questions. However, it does not
solicit written comments. Also, this notice discloses that the CO plans to issue
a third NPRM.

piece by Thomas Leonard, head of the
Technology Policy Institute (TPI), titled "The FTC's data broker report: Waiting
for Godot?". It is a response to the Federal Trade
Commission's (FTC)
document [110 pages in PDF] titled "Data Brokers: A Call for Transparency and
Accountability". It recommends legislation to regulate data brokers and others. See,

May 27, 2014.. Leonard wrote that this is the FTC's "fourth major government privacy
report in the last two years to propose new policy remedies for privacy ``harms.´´ Yet, like
its predecessors, it fails to actually find these harms. The best the commission can do in
the most recent report is point to ``potential risks´´ from data brokers ... Despite this
lack of evidence, the commission unanimously recommends that Congress consider enacting
legislation. If the phrase were not so overused these days, one might suggest this is a
solution in search of a problem."

letter to Sen. Harry Reid (D-NV),
the Senate Majority Leader, complaining that HR 4435

"National Defense Authorization Act for Fiscal Year 2015", as passed by the
House on May 22, 2014, contains the DOTCOM Act. The groups that joined in this
letter include the New America Foundation (NAF), Center for Democracy and Technology
(CDT), Public Knowledge (PK), and American Civil Liberties Union (ALCU).
