To amend the Occupational Safety and Health Act of 1970 to provide that the Act will not apply to employment performed in a workplace located in the employee's residence unless the employment involves hazardous materials or the workplace was created so that that Act would not apply to the workplace.

Mr. CAMPBELL (for himself and Mr. ISTOOK) introduced the following bill; which was referred to the Committee on Education and the Workforce
A BILL
To amend the Occupational Safety and Health Act of 1970 to provide that the Act will not apply to employment performed in a workplace located in the employee's residence unless the employment involves hazardous materials or the workplace was created so that that Act would not apply to the workplace.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
Section 4(b) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 653(b)) is amended by adding at the end the following:
`(5) Nothing in this Act shall apply to employment performed in a workplace which is located in the residence of the employee engaged in such employment unless--
`(A) the employment involves hazardous materials; or
`(B) the workplace was created so that this Act would not apply to the workplace.'.
