PETITION FOR REVIEW

Pursuant to 47 U.S.C. § 402(a), 28 U.S.C. §§ 2342(1) and 2344, and Rule 15(a) of the Federal Rules of Appellate Procedure, the United States Telecom Association ("USTA") petitions this Court for review of the Federal Communications Commission's Third Report and Order, In the Matter of Communications Assistance for Law Enforcement Act, CC Docket No. 97-213, FCC 99-230 (rel. Aug. 31, 1999) ("CALEA Order").  A summary of the CALEA Order was published in the Federal Register on September 24, 1999 at 64 Fed. Reg. 51710.  A copy of the CALEA Order is attached.  Venue is proper in this Circuit under 28 U.S.C. § 2343.

Relief from the CALEA Order is sought on the grounds that it is arbitrary, capricious, an abuse of discretion, and otherwise contrary to law; in excess of statutory [begin page 2] jurisdiction, authority, or limitation, or short of statutory right; without observance of procedure required by law; and unsupported by substantial evidence.

USTA requests that this Court hold unlawful, vacate, enjoin, and set aside the Order and the Final Rules adopted in the Order.
