Plaintiff: NetZero, Inc., is a Delaware Corporation based in Westlake California. It is an ISP and web marketer. Its attorney is William Robinson of the law firm of Mayer Brown & Platt (213-229-9500). Defendant: Juno Online Services, Inc., is a Delaware corporation based in New York City. It is an ISP. Court: U.S. District Court, Central District of California, at Los Angeles, Judge Stephen Wilson presiding. Complaint: On December 26, 2000, NetZero filed a complaint in U.S. District Court against Juno alleging patent infringement. It asserts that it is the exclusive licensee of U.S. Patent No. 6,157,946, which applies to a process that enables an ISP to display ads or messages through a window that is separate from the browser, and that Juno, a competing ISP, has infringed this patent. TRO: On January 5, 2001, the District Court issued a Temporary Restraining Order (TRO) against Juno. The Court court concluded that NetZero had demonstrated a likelihood of success on the merits. The TRO took effect on Friday, January 12, and remains in effect for 65 days. A preliminary injunction hearing is set for March 15. Trial is set for July.Related Case: NetZero v.
