The Sidley & Austin web site biography of David Carpenter states that
"Mr. Carpenter has long been AT&T's
principal appellate attorney on antitrust and regulatory matters. He has also
worked extensively on antitrust and related matters for other clients. Mr.
Carpenter has argued four cases in the U.S. Supreme Court and has briefed over
20 additional cases that the Supreme Court decided on the merits."
David Carpenter practices in the areas of appellate litigation,
constitutional litigation, telecom litigation, and energy and petrochemical
litigation.
The landmark cases in which David Carpenter has represented AT&T recently
include the following:
- AT&T, et. al. v. Iowa
Utilities Board. (8th Circuit, Supreme Court of the U.S.)
- SBC, et. al. v. FCC. In
this case SBC and other RBOCs challenged the constitutionality of Section
271 of the Telecom Act of 1996. AT&T and other IXCs intervened in
support of the FCC. SBC prevailed in the trial court. The 5th Circuit
reversed. The Supreme Court denied certiorari. See, for example, the appeal
brief filed by AT&T and others with the 5th Circuit.
- AT&T, et. al. v. City of
Portland. In this case AT&T seeks to overturn the City of
Portland decision that AT&T must open its Internet cable access
facilities to competitors. The trial court ruled in favor of Portland.
Carpenter is the lead attorney in AT&T's appeal to the 9th Circuit. See,
